"You can't simply make statements about a subject and then plead the Fifth in response to questions about the very same subject," Dershowitz said. "Once you open the door to an area of inquiry, you have waived your Fifth Amendment right... you've waived your self-incrimination right on that subject matter."

House Oversight Committee Chairman Darrell Issa (R-Calif.) indicated he could be willing to pursue forcing Lerner to testify.

“Ms. Lerner may have waived her Fifth Amendment rights by addressing core issues in her opening statement and the authentication afterwards,” Issa said Wednesday. “Although I excused Ms. Lerner subject to a recall, I am looking into the possibility of recalling her and insisting that she answer questions in light of a waiver.”

But Rep. Elijah Cummings (D-Md.), the ranking Democrat on the panel, noted the committee hearing was "not a courtroom."

“In a courtroom that might have been the case. It’s a legal question," he said.

Dershowitz said the "law is as clear as it could be" on the subject.

"Once you open up an area of inquiry, you can't shut off the spigot – that's the metaphor that the Supreme Court has used," he said.

So, correct me if I am wrong, the Justice Department pursued, indicted and tried Roger Clemens multiple times because it was perceived that he lied to Congress, right?

If the answer to the question is yes, then:

(1) can these people testifying not also be indicted if they commit perjury? and
(2) does this congressional body have the power to subpoena Obama himself to testify as to what he knew and when he knew it? and
(3) if Obama were to be caught in a lie, could he then be indicted as well (not that it would happen with Holder running things)?

Partisan much? He's on the f'ing same panel trying to get answers, but is busy excusing her for not answering questions?

I quoted and named several other prominent attorneys who say by explanation that Dershowitz is wrong. I've also laid out specifically in another thread why I think Dershowitz is wrong.

I take it that now that you sheeple seem to think what Dershowitz says is infallible and authoritative, which I've never done, you will all accept his opinion of Bush v. Gore and the Clinton impeachment, right?

If the judge sticks with the majority and the most reasoned out opinion of attorneys, and the one that defers in any case of uncertainty and ambiguity to the constitutional rights of a citizen, Lerner will prevail.

Nope. I don't care what ANY ATTORNEY says. It will ultimately be up to a judge.
