Internet Sales Tax passes Senate

Last chance to oppose this legislation is your State Representative.

I am willing to bet not everybody files for sales and use tax on all online purchases (which in LA is already the law).

The fact is you will pay more for online purchases to get goods to your door than you probably do now.

Many people claim it levels the playing field for local retailers but I feel shipping offsets tax in many cases already.

There is a small thread on Money talk but figured it would get some interest on the OT.

Let the record show that if this becomes law, Obama has taxed the internet.

It essentially changes nothing in La if you don't fraud your tax return

Shipping goes to a company, not the state.

I think it's only fair that we get charged sales tax, at least when you purchase from companies grossing more than 10 mill a year.

It would force the online merchant to collect on behalf of the State of LA.

If LA wants to enforce its tax laws on their citizens then they should have to exercise the effort to do so. Not some woman in Montana selling kitty sweaters on ebay...

Why stop here? Why not collect sales tax at garage sales and craft fairs?

Watch this now. I showed a way for a woman to lie and get WIC and was called a lot of names because that is fraud. Being the OT, I guess all of them from the states that have the requirement to report it do.

How do they expect people to do this? I do see how this is enforceable if it does pass.

Actually, a state cannot do that, which is why there is an impetus for this law. I take it you have not read Quill Corp. v. North Dakota, 504 U.S. 298?

I am about as anti-tax as they come, but this is a fair bill. Bricks and mortar stores pay property taxes and employ 5 times as many employees as online retailers. On top of that, physical stores have to collect state sales tax. I see no reason why online retailers should get an unfair advantage by not having to collect sales tax, especially when they don't employ nearly as many people and don't have to pay property taxes. The government should not be picking winners in the marketplace, and that is currently the case since online retailers don't have to collect sales tax.
