Background Check Question

Company sent me information about conducting a background check. They said

If there is anything that you feel may appear during your criminal background check (no matter how insignificant or how long ago), please include a short explanation and date(s) of occurrence(s)



When I was under 18, I was cited for drinking underage. I had the charges dismissed and am in the process of having the court records being destroyed as I was a juvenile (government is behind and still hasn't happened after a couple months)



What should I do? I was told that because charges were dismissed I can always answer the questions about convictions as no. I can pull up my court appearances though pretty easily.

I was thinking if I had to write something that it would look like

"As a juvenile, I was cited on (insert date) for a misdemeanor in the state of ______. All charges were dismissed and legal representation has advised me that I can answer all questions in regards to employment as being record free. Also, the process of clearing my court records is ongoing and should be completed soon."

I received a similar citation when I was 18 and it was later dismissed. I was advised not to even waste the money removing it from my record. I wouldn't even mention it since you weren't found guilty.

this. I've gone through very extensive background checks that never pick up misdemeanor type charges.

I would go ahead and mention it. If you disclose it, there is a 0.1% chance that you won't get the job. If you don't disclose it and it comes up in the background check, there is a much higher percentage of not getting the job.

Although I seriously doubt underage drinking as a juvenile will show up.

Looking over the paperwork it is all "Have you been convicted" type stuff

I was told by the DA's office to say no

Not true, they can see everything. I know I can on background checks I do.

I would you know what is missing if it doesn't show up? I had a misdemeanor in college, I plead guilty and paid the fine, as never shown up even on checks done by the military.

They check convictions only I am pretty sure...


U can also have anything non conviction expunged too, a charge per say that was dropped...

Some places check more than that, like an arrest would come up even if the charges were dismissed.

If it asks about convictions, then it doesn't have to be on there. Also, most background checks they do will leave out a crap of stuff. If you are arrested, for it to show up on a background check, they must either check with the jurisdiction in which you were arrested or the jurisdiction must report it nationally. To explain this better, I was arrested in New Orleans but charges dropped. My current company did a background check in Jeff Parish(This is where I live). The Orleans Parish stuff didn't show up. They don't have the resources to check every jurisdiction, and every jurisdiction doesn't report nationally.

I wonder if a DWI 1st (misdemeanor) arrest in 1988 in Monroe City Court (that was later dismissed through an Art. 894 plea) would show up? It was dismissed but not expunged.

It will absolutely show up. I had one in 1991 and I had it expunged. That fricker is just gone. All records gone.

The internet has made permanently getting rid of your arrest records a giant pain in the ass.

If you have gotten arrested recently, their is a pretty good shot you can find your mugshot on one of the BS mugshot.com websites. Those things are impossible to get rid of.

ETA you can get the actual record expunged all day long but that doesn't mean your mugshot is coming down from those websites.
