Happy homosexuals.

Just heterosexual marriage= happy heteros, unhappy homos
Hetero marraige, and Homo marraige= everyone happy.

Also i believe homosexual marriage would cut back on homosexual promiscuity, and probably help cut the spread of aids.

I think when given the option of an actual marriage and life together people will choose that over promiscuity, or at least a portion of people. Less people fricking around equals less chances to spread aids.

Actually the nuclear family as a societal building block is a fairly sound argument if you choose to argue against any sort of gay union. I don't. But the basis is that by encouraging heterosexual marriage, social stability is enhanced and government costs are reduced. e.g., Dissolution of a traditional married family unit is less likely to result in government dependence than is dissolution of a non-married assuming each result in single parent households.

Giving gays the same privileges doesn't take away the advantages of heterosexual marriage vs divorce or not getting married.

Valid point.

but don't you also get deductions for your kids?

Families without kids still get these rewards while not being nuclear families, and not really benefiting society in the same way a family would.

I think if you only got benefits for being a family with kids, you would see more of a push for gay adoption rights nation wide. well basically it would be what people are saying the government getting out of marriage, but still giving incentives to maintian families.

Granting privileges to heterosexual couples could be considered a compelling state interest since it is deemed to promote the propagation of the species. This permits the state to discriminate against homosexual couples by denying them the same privileges. One of those privileges denied homosexual couples could be the tax benefits of being married. Is that simple enough for you to understand how laws that deny privileges can pass constitutional challenges? Denying privileges is a form of discrimination. Thus, discriminatory laws can be constitutional if there is a compelling state interest.

I'm willing to concede that hte Supreme Court will consider the compelling state interest and any conflicts with other constitutional guarantees. The Supreme Court may give more weight to those other guarantees than the state's compelling interest and rule against the discriminatory provisions. That is one of the unknowns of litigation. You can never predict how judges will rule with any certainty as they have multiple approaches to every issue available to them.

what is the legal backing for this statement. I am not accusing you of making it up, i would just like to better educate myself on the principle.

No i think pure equality of rights is a strong enough argument, but i see this as a possible benefit.
