There is no excusing anyone that knowingly gets behind the wheel drunk. They know fully well what they are doing could kill someone but instead of being responsible and letting someone else drive them, they choose to drive drunk and if someone dies then that just sucks for them.

I'm just going by the OP where the news story said his blood alcohol level was twice the legal limit. That indicates to me the guy was drunk.

I think the fact that the father no knowing the driver was drunk will work on his behalf. Just goes to show it was temporary insanity and not meditated. This guy watched his kids get killed, snaped and thats all.

I responded to RAGINCAJUN, who brought up that other case. Try to keep up. Like it or not, when someone unintentionally collides with another, it's an accident. Murder and homicide are alike in that both have the same outcome. However, intent has to and is taken into account, both from a legal and a moral point of view. No one is absolving the person who had a few drinks and drove. You're constructing a straw man there. What we are saying is that even if the driver had a BAC of .3, the shooter had no right, legally or morally, to leave the scene, return, execute the driver, and hide evidence. Period.

True, but it's not necessarily "cold blooded murder" as some think it is. There will be considerations.

I just googled this. I can't find anything about a "legal limit" for minors in Texas. This chart shows the legal limits by body weight (what did this guy weigh?) and how many drinks it takes to get to that point. Notice how a man who weighs 200 lbs with a blood alcohol level of .04 is shown with "Driving Skills Significantly Affected". And he reaches this point after only two drinks. So if this guy was average size and his blood alcohol level was .04, then he had no business driving. This came from a website of a lawyer who appears to be a drunk driver defender btw and not some anti-drunk driver website. ETA: This is all I can find about the legal limit in Texas....

This. There is nothing evil about a drunk driving accident. It's exactly that...an accident, caused by stupidity. I would only be ok with this kind of thing for child molestation, rape, cold blooded murder, etc. Truly evil acts.

Could and will are two different things. There is a reason that Donte Stallworth wasn't charged with First Degree Murder... Actually, this case is very similar to that one, with the added bonus of actual murder.

I have looked and looked and found nothing about Texas having .02 as a legal limit for minors. The only thing I've found is that Texas has a "zero tolerance" policy and that anyone under 21 with any traceable amount of alcohol in their blood is guilty of DUI.

I don't think anyone said it was legal for the guy to drink a few beers and drive. They were saying .04 or whatever doesn't really impair anything. Also, this could prove their point. Technically this dude could have drank one beer and been considered drunk. Obviously one beer isn't drunk.
