I think I would do the same exact thing in that moment if I could obviously tell the a-hole was drunk. There is no living with watching the drunk dbag who killed your kids walking away with the lax DUI laws in this country. Id love to sit on that jury. Good for him.

I think the guy would be in jail for at least 20 years if didn't get shot shortly after the incident.

He is responsible if he shot the guy... who else would be responsible for the man's death if the Dad got a gun and shot the guy???

The dad would have been the one who decided to end his life, whether he did it while under distress or insanity.

Did the driver decide to end an 11 and 12 year old's life when he got behind the wheel? Maybe, maybe not... we will never know.

ETA: from the report in the OP, they don't know if the driver was drunk, they don't know that the dad shot the driver.

But if the OP assumptions are correct, we must consider whether the driver intentionally killed the kids, and whether the dad intentionally killed the driver.

updated the op with another article stating his bac was double the limit.

i would think hiding the gun hurts his ability to claim temp insanity. don't think they have recovered the gun yet.

Nope. Up to 30 yrs prison. I represented a guy a couple yrs ago for that and he's serving 20 now.
