The point being that they can in their opinion whack Americans when they choose.

This. It doesnt matter if they are a terrorist, if they are an American citizen then they have the rights that go with it. Every American, no matter what their crime, has the right to a trial.
Its that other guys thinking that leads to this kind of power grab. It eventually leads to anyone saying anything that goes against the government being labeled un-american and therefore a target for assassination.
