| How long is a typical No Compete Clause? (Posted on 1/30/13 at 11:12 am)
I have a great job offer but they just hit me with a 5 year no compete. This seems a little long. Is this normal?

I thought 2 years was the max. It also must have a geographic constraint, and it cant be a whole state. Just certain parishes/counties, or a certain region. That is for non-compete, I'm not sure if no contest is the same thing.

I edited. I meant no compete. So, should I be skeptical? Also, I'm in Tennesee

I would be skeptical. Anything over 2 years will likely not hold up in court. If your really worried, I would talk to a lawyer.

I've never heard of a non-compete of more than 2 years. Lately, I have seen a lot of 12 month clauses. And limited by geography.

For medical professionals, typically two years within a certain geographical location (i.e. 30 miles from the location of the practice).

It's a state law issue, and the states vary greatly in their laws on this matter. So, unless someone on here is barred in Tennessee, I'd treat it like just someone's opinion -- where an opinion is like an as$hole - everyone has one.

Good links. Doubtful that a TN court will uphold a 5-yr. restriction.

If you sell a business and sign a no compete clause it should be rock solid for however long the term is. If you are just an employee any term is pretty much not enforceable.
