And only tell that "one story" to your lawyer.

I would like to see the evidence play out before we judge this old man. A quick reading of the story leaves allot of information out. And a few suspicions. Not saying it's not a crazy old coot that went trigger happy, but there's ALLOT that needs to be uncovered here.

Maybe, maybe not. 1- Is there really a 'friend' in the vicinity? 2- Which GPS device were they using and what did it record prior to the shooting? 3- Were they on any drugs/alcohol at the time of the shooting? 4- How far into the mans driveway was the vehicle? Allot that we don't know yet.

Example: Is the driveway a typical neighborhood driveway in a subdivision that is about 30' long? Or is it in a rural area with sparse neighbors and maybe 300' long? That one piece of information can make a massive difference.

I know it's early, but at first glance it reads very similarly to the Yoshihiro Hattori case in BR - the Japanese exchange student who was shot for knocking on the wrong door. LINK

He fired a warning shot. What happened after that?

Meh, I'm typing fast and TD (or the google browser) offers up ALLOT for when I right click on the red-underlined ALOT that I originally put. Don't worry, I have a good education.

Two people in the car with him. You think they just heard gun shots and decided to run over to the dead body and wait for the police to pretend they were in the car with some random guy who is now dead?
quote:
2- Which GPS device were they using and what did it record prior to the shooting?
Interesting question regarding the credibility of the witnesses, but if the physical evidence shows the car was moving away from the house, pretty irrelevant.
quote:
3- Were they on any drugs/alcohol at the time of the shooting?
Again, could go to the credibility of the witnesses, but otherwise mostly irrelevant.
quote:
4- How far into the mans driveway was the vehicle?
Unless it was in drive and heading towards the man, why does it matter? Do you think a car pulling all the way into the drive way gives someone the a reasonable apprehension of serious bodily harm or death such that deadly force in response is justified?

I actually did something similar in high school. We were in a rural area looking for a bonfire party. I follow mg two buddies vehicles onto some property. We get into a clearing and he leans out the window saying "we have the wrong place." As we turn the vehicles around the owner came out with a dog and a shotgun. They were able to get by him but i had to stop because i was terrified and he was almost in front of my vehicle. He thankfully gave me a second to explain myself. He was so pissed and seemed so close to wanting to shoot it was pretty scary.

No, silly. Was there a 'friend' that lives like two doors down from the old coots driveway that they supposedly mistook. If they can't produce a credible reason for being in that man's driveway by mistake, the whole "GPS put us in the wrong place" argument falls apart.
