Re: NY Gun Law; Officers not exempt

quote:

NEW YORK (WABC) -- It appears someone forgot to exempt police officers from the ban of ammunition clips with more than 7 bullets in New York State's new gun control law.

It's a big oversight that apparently happened in the haste by the Cuomo Administration to get a tough package of gun-control measures signed into law.

On Tuesday, Governor Andrew Cuomo signed the sweeping gun measure, the nation's toughest. It includes a ban on the possession of high-capacity magazines.

Specifically, magazines with more than 7 rounds will be illegal under the new law.
The problem as the statute is currently written does NOT exempt law enforcement officers.

The NYPD, the State Police and virtually every law enforcement agency in the state carry 9-milli-meter guns, which have a 15-round capacity.

Unless an exemption is added by the time the law takes effect in March, police would technically be in violation of the new gun measure.

Within the last hour, the Patrolman's Benevolent Association President released a statement saying, "The PBA is actively working to enact changes to this law that will provide the appropriate exemptions from the law for active and retired law enforcement officers."

The last highlighted part is disturbing.... Why should retired law enforcement officers be exempt from the law? They are no longer civil servants, why are they better than everyone else?

That's a good question. I'd like to hear someone who supported the ban answer it.

ETA: Maybe they would have caught this had Cuomo not waived the State Constitution's requirement of a 3 day waiting period between a bill’s introduction and a vote in the General Assembly.

federal law dealing with this signed by Bush

don't know much about it, nor how it relates to the separation of powers, but if this part is true: "allows two classes of persons—the "qualified law enforcement officer" and the "qualified retired law enforcement officer" -- to carry a concealed firearm in any jurisdiction in the United States, regardless of any state or local law to the contrary, with certain exceptions."

then the omission in the NY law is irrelevent

Perhaps with a limit the NYC cops will learn to shoot better and not waste ammo and shoot innocent bystanders in the process...

I love how certain officials seem to exempt themselves from laws.

The whole thing is disturbing, but yeah, government taking care of their own... Nothing new there.

No, it is still relevant. The federal law has to do with the ability to carry a concealed weapon. The NY law involves clips that can hold more than 7 rounds. Two completely different things.

I support law enforcement, no question. However, we, as individual citizens, face the same threats they do. If our rights to self-defense are curtailed, law enforcement should be under no special exemptions, period.

I understand your point, but I will assure you that ALL the cops I have talked to DO NOT in anyway support anymore gun laws. This is a state issue and each individual state should pass the laws that fit that state.

Question. If the 7 round restrictions and hard line anti gun restriction are to have the effect of making the streets of New York safe, then what do cops need more than 7 rounds for now anyway?

Do you really believe that the bad guys will only have 7 rounds?

I believe that's the point. If they wont, why do only cops deserve the ability to defend themselves properly?

How many people in NYC would have been spared from being shot in the fall if the cops would have had 7 round mags? Do it for the citizens...

I agree, 100%. You deserve the right to protect yourself and your family. The gun laws we have now that say convicted felons and mentally ill persons cannot possess weapons are good laws and should be stronger. Law abiding citizens should have the right to own weapons.
