Congress doesn't amend the Constitution. It can put forth legislation for that, but that must pass both chambers with a 2/3 vote. That's never passing the House.

If it did though, it would then need 3/4 of the state legislatures to pass it and that damned sure will never happen. Federal, State and Local politics are different creatures, with party politics meaning less and less as you go down the line. I seriously don't think there would be enough state legislators willing to vote for such an amendment.

By precedent, Biden could just issue an executive order allowing Obama to remain president. As long as the Supreme Court continues never challenging the vastly over-stretched power of the EO, the president is essentially a democratically elected king with absolute authority.

Biden wouldn't hold any office. He would have been on the illegal Obama-Biden ticket. They were a package deal.

I can't decide whether you just aren't smart enough to realize that that is legally impossible (for a number of very simple reasons), you are just trolling or you just threw random words together then sprinkled in some punctuation.

Well, since the Gulf of Tonkin incident, the power of the executive order has been completely changed from merely enforcing or implementing laws passed by Congress to becoming law itself. It has no check at the moment. Therefor, if Biden were to succeed Obama as president (not a certainty in this crazy hypothetical as Biden may be removed due to being on the same ballot putting Boehner (not much of an improvement) in charge), he could simply issue a pardon, issue an executive order making Obama eligible to hold the office of the presidency and vice presidency, name Obama as his VP, resign from the presidency, and then have Obama name him as his VP.

Done, done, and done.

As I read this thread, I think it is worth repeating again, that the title is not accurate. All that happened was Kennedy said this is so stupid we shouldn't even talk about whether to hear the case. Roberts came back and said no, lets at least vote if we want to hear this case.

The odds of 4 justices saying yes and actually agreeing to hear the case I imagine are ridiculously small.

AS of now the supreme court has not agreed to hear this case.

Okay... *IF* Biden were made President instead of being thrown out with Obama he could indeed issue a pardon to keep Obama out of prison.

What he could NOT do, however is issue an executive order making Obama eligible to hold the office of the Presidency nor Vice Presidency. Those qualifications can only be changed by Constitutional Amendment and there's no way in hell you could get 2/3 of BOTH chambers of Congress to go for that.

But even if you did, there's no way in hell 3/4 of the state legislatures would vote in favor of it.

So you have something that is legally impossible (even a breath of trying to change the qualifications by EO would get bitch-slapped by the Supreme Court) buttressed by two statistical impossibilities.

You might want to find another conspiracy because that one would never even get off the ground.

Legally impossible doesn't mean jack shite if it isn't enforce. You know the adage, "if you don't get caught, everything's legal." They have already passed NUMEROUS illegal executive orders, yet they're still law! There have been countless laws passed by Congress that are completely beyond the scope of the powers of that legislative body, yet many of those laws have stood for over a century. Unless the branches actually act as checks and balances against each other rather than unilaterally all approving one-another in order to increase power for them all, as long as the document that prohibits this behavior is ignored and remains unenforced, NO LEGAL REPERCUSSIONS WILL RESTRAIN OUR EVER-EXPANDING FEDERAL GOVERNMENT.

These what if threads are consuming this board. It's literally like reading post from 12 year olds.

What if Obama loses this?
What if they take away our guns, would the military cooperate?
What if the states seceded when they take away our guns?

At least start getting more interesting and do some what if Mike escaped his cage and attacked Saban?

What if the top decks fell in Tiger Stadium in the middle of a game?

What if the Dallas Cowboys hired Miles as their HC?

I mean if you're going to be ridiculous, you might as well go all the way!
