This cannot possibly be right. How does he have that authority? The ACA clearly gave states an option: use the fed's exchange or create your own. Not sure how he can charge a fee for something the bill provides for. I strongly suspect, but don't know for sure, that this is a way to cover for the fact that the federal exchange is way behind schedule.

This fee just demonstrates that Obamacare is not intended to improve the efficiency of healthcare and reduce the costs. It is intended to reward some and punish others through redistribution of wealth. Obama is sending a message that he will punish anyone to get at those he perceives as his enemmies. Even the unfortunate Democrats who might happen to live in states controlled by Republicans. I guess thay are acceptable casualties from friendly fire.

She was given that power---unilateral, carte blanche, whatever you want to call it---regarding the implementation of Obamacare. I remember reading about it somewhere quite a while back and thinking she could screw over whole segments of the population and Obama wouldn't get the blame. Annnnnd, here we go! Don't think she did this without running it past Daddy-O first, though. Hell, it was probably his idea.

EPA, Homeland Security, HHS... RULES are the new laws... can be modified or changed at any moment to suit the ruling class. Legal means diddly poo anymore.

I would just like to offer up a big frick YOU to CJ John Roberts. Scalia and the others warned you about this shit, but you didn't want to "politicize" the Court. Instead, you effectively neutered it, and in the process, made the power/scope of the central government absolute so long as the "taxing power" the mechanism of passing legislation. Again...frick you.

BTW, this is a "taste" of the "price" to be paid for exercising rights. Expect churches that refuse to marry gays to lose tax-exempt status.

He can fine them all he wants. It's my understanding per the SCOTUS ruling on Obamacare the states just don't have to pay the fines and cannot be bribed or held ransom by the federal government to implement Obamacare. A quick lawsuit should resolve this pretty quickly.

There is no funding mechanism for federal exchanges in the law. I suspect this is being used to cover the cost of setting one up since the states are not going to do it.

Now that I think about it, it seems like a political ruse: Step 1. Fine the red states Step 2. Red states pay fine - funds Obamacare Step 3. Red states sue the federal government Step 4. Red states win - GOP lemmings are happy and GOP politicians get cover. Step 5. Federal government pays lawsuit out of a separate fund. Unfunded Obamacare gets funded...that's the end game.

Seems right. Add in that any parts of the federal exchange that don't work will be blamed on obstructionist red states that refuse to cooperate.

This is but another step in the direction of forced socialism. I expect the division in this country to be even wider within the next year. I suspect a few riots will start happening like in Greece.
