No Proof of Insurance Question

So a buddy of mine got rear ended on the interstate on friday. He didn't print out his new insurance card but has current insurance. The state Trooper had my buddies car towed even though it was fine to drive and it's in the state impound lot for the weekend. He cannot get it until Monday.

My question is, is that normal procedure? I thought they just gave you a ticket if that. I actually thought they could check on their computer if you have insurance

i think its a new law that towing is at the officer's discretion for no insurance on person

Cop was a dick. I got pulled over the other day with an out of date card, but the cop let me pull up my info on the insurance website from my phone and show him.

If he had a smartphone on him he could have logged in to his account online and showed it that way. This was a new law past several months back.

Bull shite. If you're covered, it shouldn't matter if the paperwork is in your car, your wallet or your grandma's ass. Covered is covered.

Ok thanks for the info. I understand that he screwed up by not having it on him but towing the car for the weekend is pretty harsh, especially since he was the one that was hit and not the cause of the accident

My friend couldn't pull it up online but showed the cop an online bank payment to the insurance company but the cop didn't care

Normal procedure.

The Law Enforcement Officer, whether it be city, parish, or state, CAN use their discretion and call the insurance company you claim to have coverage through and verify, but they don't have to, and are usually discouraged from doing so by their superiors.

Refer to Louisiana Revised Statute: 32:874.2.

It's your responsibly to carry proof, not the LEO's job to check.

Towing is standard operating procedure since under no circumstances can an uninsured vehicle be driven on any roadway.

Thanks, my buddy isn't pissed as he is just annoyed that he allowed that to happen. I hadn't heard of that before and my Google searching didn't turn up what I was looking for, td comes through in a pinch

I think it's at the officer's discretion. In your friend's case, it's BS. He should've given your friend time to call his insurance agent/agency, have them email him a copy of the insurance cards proving he had valid insurance and show that to the officer on his phone.


Sounds like the cop just wanted to be a jerk.

I don't know why the State Trooper didn't let him call his insurance company to tell the cop that he had current insurance. They do this all the time.

Driving without insurance is a big fine, but it will be greatly reduced (usually) if you show up at your trial date with proof of insurance.

Gentlemen,

There are two separate Revised Statues pertaining to this situation.

1.) LA RS 32:861 - Covers regulations that all motor vehicles must have insurance.

2.) LA RS 32:876.2 - Covers regulations that you must have proof of said insurance in the motor vehicle.

In Fratastic's friend's case - If he really was covered during the time frame he was cited and had his vehicle towed, he will bring his proof of insurance to the DMV, pay a fine, be given his license plate back, and then be able to remove his vehicle from the impound lot.

However, whether or not he had active coverage during said time period he still violated RS 32:876.2 by not having physical proof in the car.

I'm not saying it's not a crappy situation, I'm just stating what the law reads.

As it is so often elegantly put "pigs" don't make the law they just enforce it. They're not out to get you, they're just doing their job.

How big is the fine? A lot of people in Nola drive without it and I freak out when driving certain areas because I know I'd be screwed (I have the state minimum) if I got into a fender bender I wonder if they really save that much by not having it if its such a big fine

got pulled over for out of date inspection. didn't even have insurance. cop was cool, just asked me why I didn't have insurance and wrote me up for not having proof of insurance and tag. he could have impounded or at least put a sticker on window. said that he didn't want to put the sticker on the back window because that would be a magnet for other cops to harass me. pays to be nice and upfront with your issues
