The two BP well site leaders (Kaluza and Vidrine) are the two facing manslaughter. Both of them took the 5th during investigations. But, I think they did the right thing since the DOJ was looking for people to crucify, and they will now have to defend themselves in a court of law.

The deep water horizon isn't owned by BP it's owned, staffed and operated by Transocean. BP only owned/possessed the exploration rights of the drilling site. How is BP liable to criminal penalties totaling billions of dollars if the rig wasn't under their direct control? I know they have the bigger pockets but am I missing something?
BP is the General Contractor, who sub contracted out the drilling.

The Justice Department opened a criminal investigation of the spill. The only person facing charges so far is former BP engineer Kurt Mix, who was arrested in Texas in April on obstruction of justice charges. Mix is accused of deleting text messages about the company's response to the spill, not what happened before the explosion.
I really question how they could successfully prosecute two others for manslaughter. Even though, IMO, exaggerated claims have been made about what "they" should have known that would have prevented the disaster, I've seen no evidence that would warrant the charges. This comes across like bloodlust to satisfy the cries for justice and retribution. ETA: making the mistake of accepting bogus explanations that misinterpret readings would be, could be, gross negligence. Just don't know if it rises to the level of 11 manslaughter counts.....a possible life sentence. Also, wasn't there a fail safe built in that didn't function?

I know of at least 3-4 people who were identified in the investigations to have been inolved in the same negative test interpretation at some point of the tests....why aren't they facing equivalent charges?????? Likely b/c they cooperated with the investigations and their own companies never threw them under the bus. When the DOJ came out immediately after the incident and said (without knowing aything about the incident) - "we will hold all parties criminaly accounted for".....the 2 highest company men on the rig shut their mouths....now they are facing 11 counts of manslaughter.

The manslaughter charges are complete and utter BS. It has been awhile since I have gone over the details regarding the blowout but the Gov is looking to make an example and BP is offering up the lambs. Are those engineers responsible, of course they are but so are 20 other individuals that were on that rig that day. May they RIP but the mud men along along with the driller and TP all should have shut that well down as soon as sign of the kick were seen. Furthermore, BPs over ruling in this situation, while reckless, was not a unheard of thing. I wont call it common practice but like I said, it wasn't unheard of. I am in no way waving BPs culpability but to try and tag MS charges on any one in this situation is more than a far stretch IMHO.

I'd have to go pull out some notes and documents to refresh my memory as to the details, but I sat in a symposium on marine liability and the Deepwater Horizon incident not long after it occurred and I remember being fricking appalled at the gross disregard for safety procedures in the days leading up to the disaster. They were behind schedule and that trumped everything apparently. And it ended up biting them in the arse and killing 11 people. fricking awful. No excuses.

Engineering disaster of the first order. Totally avoidable.

Do yall think there is a case of the MS charges. Like I said it has been awhile since I have gone over the details but personally think that there was way to many factors that took place in order for this to happen to make those charges stick.

Agree - complex but won't stick with a jury trial.
