That is NOT the same thing as an illegal arrest. That's exactly what I was saying about people not understanding the law. A cop can arrest you in good faith even if ultimately it turns out that you didn't commit a crime. If you fight back that's resisting arrest. If a cop just outright makes up some bull shite to arrest you, that is the same thing as false imprisonment, and you can resist up to and including killing him if need be. It's all about good faith on the cop's part.

That's not what I said. There wasn't a crime that was even committed.

This is what I'm talking about.

You are okay with this?

so a cop just showed up out of the blue and arrested your friend for no valid reason? I somehow doubt that

Yes, I'm okay with a cop being allowed to make a good faith arrest.

The cop was in the area. And yes, the cop was asked a question.

And then, even if nothing illegal occurred, forcing the individual to defend themselves in court?

I simply don't believe you're telling the whole story.

First of all, i've never heard of anyone having to go to court when there was not even any evidence of a crime. That's just ridiculous. Second of all, I still think you're confusing ultimately being found innocent with a bad faith arrest. They are NOT the same thing. It is not illegal for the police to arrest the wrong person, and that is NOT a valid reason to resist arrest. An illegal arrest ONLY pertains to if the cop was using his power to arrest for something outside of his official duties. Just as an example, there was a thread the other day about some piece of shite who was arresting women and raping them. If one of those women had fought back and killed him, they would not have been charged with resisting arrest nor murder. Simple as that. It's called common sense, do you have any?

I agree. But he's had to retain counsel because of this.

So, are you saying that the individual (non-cop) wouldn't be arrested, printed and placed into a cell until making a court appearance for bond?

Good god. It's not like i didnt know that happened, but listening to it is disheartening. Cops are getting dumber, more arrogant, and more power crazy. And its effecting everyone. Not just minorities.

Arresting someone illegally or wrongfully are one in the same for the person getting the cuffs slapped on them. At the end of the day, they have done nothing wrong but have to bear the burden of defending themselves because of an officers actions. In both cases they should not be arrested.

Please explain how you can determine if I am confusing something (intentionally or not) with what you yourself posted after (cough) texting a DA you know.
quote:
i just texted a DA I know pretty well and she says that if the circumstances were a real to life illegal arrest and the person killed the cop, she would rule it self defense and not prosecute.
All I asked was would or wouldn't the individual (non-cop) still be arrested, printed and placed into a cell until making a court appearance for bond? Now if you can't bull shite your way to an answer, just man up and admit it, but don't you ever make a statement that I am confused about any of the bull shite that spews from your keyboard.

No, you've demonstrated that you don't know half as much as you think you do, and it's time to run and hide again.
