I believe you would be justified unless you used deadly force. One never knows what a jury will think.

if the officer isn't acting in good faith. Then yes you have a right to defend yourself, including using deadly force. Now, if it's a situation of mistaken identity or something similar, and the cop is acting in good faith, then no you have no right to self defense, the arrest is a legal arrest.

legally speaking the jury, if it got that far, would only be deciding on whether the attempted arrest was illegal or not, since in order to use that defense a defendant would have to stipulate that they did in fact kill the officer. I don't know of any cases where it's gone to court, simply b/c most of the time a grand jury will make that determination.

Yes. The PD will still arrest you. The DA will initiate the charge, then force the innocent to defend themselves.

Hmm, strange, i just texted a DA I know pretty well and she says that if the circumstances were a real to life illegal arrest and the person killed the cop, she would rule it self defense and not prosecute. You guys just hate the law so much its crazy

I know someone that has retained an attorney to defend a resisting charge when there was no crime committed.
