That's a whole different topic, but worth thinking about

up until the point of killing the cop who is trying to illegally arrest you.

What about the hypothetical situation where the cop trying to illegally arrest you threatens deadly force, or charges at you from a distance of about 5 feet? Would you then, be justified in defending yourself?

Yes you are speaking of the law...I was speaking of policy...which clearly isn't the same everywhere.

I believe you would be justified unless you used deadly force. One never knows what a jury will think.

if the officer isn't acting in good faith. Then yes you have a right to defend yourself, including using deadly force.

Now, if it's a situation of mistaken identity or something similar, and the cop is acting in good faith, then no you have no right to self defense, the arrest is a legal arrest.

legally speaking the jury, if it got that far, would only be deciding on whether the attempted arrest was illegal or not, since in order to use that defense a defendant would have to stipulate that they did in fact kill the officer.

I don't know of any cases where it's gone to court, simply b/c most of the time a grand jury will make that determination.

How do we stop cops from becoming shitty cops?

For starters, how about accountability, ethics and integrity.

quote:

Through my appearance here today...I hope that police officers in the future will not experience...the same frustration and anxiety that I was subjected to...for the past five years at the hands of my superiors...because of my attempt to report corruption. I was made to feel that I had burdened them with an unwanted task. The problem is that the atmosphere does not yet exist...in which an honest police officer can act...without fear of ridicule or reprisal from fellow officers. Police corruption cannot exist unless it is at least tolerated...at higher levels In the department. Therefore, the most important result that can come from these hearings...is a conviction by police officers that the department will change. In order to ensure this...an independent, permanent investigative body...dealing with police corruption, like this commission, is essential.. - Frank Serpico testifying before the Knapp Commission, 1971

Sickening. You can hear the anger in the cop's voice... over nothing. Just bullies looking for trouble, plain and simple.

doubtful.

you do realize the DA charges people with crimes, not the police, right?

Yes. The PD will still arrest you. The DA will initiate the charge, then force the innocent to defend themselves.

Hmm, strange, i just texted a DA I know pretty well and she says that if the circumstances were a real to life illegal arrest and the person killed the cop, she would rule it self defense and not prosecute.

You guys just hate the law so much its crazy

I know someone that has retained an attorney to defend a resisting charge when there was no crime committed.
