This Ed O Bannon lawsuit could alter college sports as we know it


This thing is starting to get some teeth.

U.S. District Judge Alfred V. Covello has ordered ESPN to provide O'Bannon with its television and licensing contracts for Division I men's basketball and football since 2005. The order sets the table for O'Bannon to gain a much better understanding of how much the NCAA profits from current and former players' names, likenesses and images. The order also highlights how the O'Bannon case threatens not only the NCAA and its member institutions, but also companies that have profited from Division I men's basketball and football through contracts with the NCAA and members

Interesting... EA Sports NCAA football comes to mind.. There's no names but the jersey numbers are accurate and obviously modelled after the real player.

i don't get his claim. i'm pretty sure part of an NCAA scholarship contract involves licensing rights going to the schools

shite like that piss me off, nobody force these athletes to go to MAJOR schools. They can go to FCS, Div II or Div III schools if they don't want all the fame and glory.

no. those are all NCAA schools. they'd have to go to an NAIA school (and i'm sure that has similar provisions)

As if the $80,000 worth of scholarship money they get over 4 years isn't enough for a student athlete. And on top of that they get stipends and such for food on road trips, free gear, free place to stay (and if they don't use the max allowed for their apartment they are paid the difference back).

Student athletes are spoiled enough.

Don't research students have the ability to keep the rights to their research?

For instance, Stanford didn't get Google when Sergey and Larry created it.

Yeah but isn't he simply complaining they're all adhesion K...

The athletes (especially now) have to attend a University to get to the NBA, you have to go to a University to mature and make the NFL...so if you want to pursue your livelihood...here's a scholarship and oh, by the way - if you accept it, you have to accept all these other hidden provisions regarding profits made on your behalf/likeness. You get free room and board, we (the University) get everything else.

I don't think this will alter sports - that can of worms might be too much - but like a new garage band that signs a long-term crappy record deal and then becomes huge/profitable...the NCAA may make changes/% to address this issue.

Individually, and in a vacuum, he probably did not.

However, the NBA has (probably rightly) determined that collectively as an organization, it needs the exposure of NCAA basketball to help create interest in its product by highlighting and exposing upcoming players before they get drafted into local franchises. That is what creates value for those organizations, that in turn and in part is what allows them to pay the salaries they do.

This seems to be the whole trick bag of this situation, and where I think what a lot of these people think they want, would ultimately be a case of killing the goose that lays the golden egg.

Correct, no one year rule when he was in college.

Plus, that problem would be with the professional league, not the NCAA, since the NCAA doesn't enforce or have that rule, the league does.

You can certainly play in the NFL without college, just have to be 3 years after your graduating high school class, that's the requirement. No rule on "how" you spend that 3 years.

So if it ends up being a class action lawsuit every athlete will get about $25

You would probably have to include all female athletes as well

IIRC the lawyer has added some plaintiffs suit to the suit in order to overcome this issue.
