How is she being charged when it's obvious that the kid has emotional and behavioral issues?

I don't get what this has to do with anything except that if they're truly ED, it's an even bigger issue of consent.

According to he link the guy was 17. Nothing to see here. If he was younger it would be different.

Plus the kid is ED....that's considered a form of mentally disabled.

You don't get sent to those types of schools with just behavior issues. That is considered the worst of the worst as far as SpEd assignments go--we are talking kids that have to be restrained on a daily basis to keep them from killing people. Shoot, I've seen some pretty bad kids still stay in "regular" schools....kids who will walk up to anyone within their reach and try to stab them with a pencil....public masturbators, defecators, screamers.....the only one I know of who got sent to one of those schools was an older kid who killed his sibling.

My point being that a 17 yr old guy is much different than a younger one. I joined the army two weeks after turning 17. 16 is iffy, anything younger though is where there are problems.

You bring up a good point. If the guy is mentally disabled that changes everything.
