Mold was found in my condo, can i get out of my lease

Long story short, I have a fairly high end rental, wont discuss specifics but the building im in had a significant water main leak from the 20th floor down to the 7th...for the past 5 days Ive been sleeping on the floor in the living room while fans were drying the walls in my bedroom.

Yesterday the bulding security and a mold company came into the condo and said my condo had mold behind the laundry machine and they cut out a significant chunk of the wall and i took pictures of it and they sprayed some stuff and put a piece of something over the wall and taped it.....the fans continue to dry in my bedroom and they have some other machine with a long tub dumping little bits of water into my bathtub

Also My gf has been having horrible headaches the last few months and has gone to 3 doctors and none have found anything wrong with her and now im starting to believe it may have been from this mold.....anyways...

Anyways this has all become a pain in the you know what especially when your rent is as high as mine is....frankly the building isnt as high end as they made it seem when i signed the lease and id rather go live somewhere else....anyways the unit is owned by an individual and not the building....so can I get out of the lease now? what steps would I need to take if I can....

Also upon move in I paid first,last, and security so 3 months rent.....what can be done about the last 2 in the event i can move out legally.....landlord is rich guy in Argentina....

I never took sales and lease because PMH screwed me over by changing the schedule at the last minute but if memory serves there is a "habitability" rule in the code that would allow you to get out of the lease but I'm pretty sure you first have to notify your landlord of the problem and he gets 30 days to fix it. Sounds like an attempt to fix the problem has already been made but and I'm not sure on all the specifics that are tied to that. Also if you can connect your GFs headaches to the mold that's a whole separate potential action.

I'd repost this on the OT and put "OT Lawyers: Lease question" in the title.

think you are stuck in the lease, unless the landlord knew about the problems and didnt tell you

I don't think so. It's a health and safety issue. It also may depend on what type of mold they found. However, taping over it and closing it up is not a proper way to deal with mold.

No they cut the mold out and taped over the hole what should they have done...they also sprayed some stuff on it as well? Should I call and ask what type was found?

So how did they know mold was present and how did they know exactly where to look and then declare that there was no more? Sounds fishy to me.

They entered our condo 4 or 5 days ago and removed floorboards in bedoom placed (1) fan and 1 machine with a hose that goes into bathtub drain....they said the whole "01" line of our building was affected...they then return daily to check...then 4 days later they said we had mold behind the washing machine and cut it out and put this black sheet over the hole and taped it and said repairs coming this week....today they came to check bedroom again and removed fans....I'm not a mold expert but what's so off abt what I'm saying?

You could try to bring up the word attorney in the mix. This happened with my sister. Well it wasnt with mold but I would bring it up about not being safe. I would also mention that you have spoken with attorney about the situation but best of luck.

If they are fixing it, I think you would have trouble getting out of the lease. JMO. I wouldn't like my chances in Court with that fact scenario.

However, with the possible medical condition of your ol lady and if you only have a few more months on the lease, I'd contact whoever managers the building and try to get a reduction or get out of it on amicable terms without paying anymore than you have. You may have a lawyer friend who can write this type of letter for you.

It there was that much water intrusion they should have removed the baseboards, drilled holes in the sheetrock, put in more fans and a big arse commercial dehumidifier to dry the walls/floor quickly. If the mold was gone after cutting out the wall they would have no need to tape up plastic and instead should have left it open to dry faster. If the area wasn't dry in 3-4 days they aren't very knowledgeable of what they are doing.

mold is now gone. One thing about mold that differs from asbestos, is once exposure is removed health issues quickly return to normal.

i have been involved in many high rise condo designs, and what they call high end is what you see as finishes. But what is in the walls/ceilings (plumbing, HVAC, Elec) is as cheap as you can get.
