criminal informants are not typically that reliable.
this is a major concern. What if the informant had a vendetta against the defendant and gave the police false or misleading information?

Just from reading the portion of the article in the OP this guy should not be charged with anything other than possession of drug paraphernalia and unlawful possession of a fire arm(if he was not allowed to own one)

No-Knock Raid Results in Dead Cop, No Drugs: Prosecutors Push For Death Penalty

quote:

A no-knock raid is a law enforcement technique designed to search for incriminating evidence while taking suspects by surprise.

quote:

Still, the Killeen Police Department lost one of its own in 47-year-old Officer Charles “Chuck” Dinwiddie, and that isn’t lost on the prosecution, notes KWTX. The outlet originally broke the news prosecutors would be seeking the death penalty in spite of the probability that Guy, awakened at 5:30 a.m/ by the no-knock raid, was simply shooting wildly at what he believed to be armed intruders.

quote:

While the evidence presented thus far does not indicate that police had substantial reason to believe Guy was a drug dealer, the case is still in the early stages of being tried, so it’ll be interesting to see how it develops.

my frick the police radar is going off like crazy right now.

even more reason to vote for Rand

I cant believe this guy is alive, my only guess is the POS cops cant shoot for shite and hauled arse when he started firing at them. Where I am from the dumb asses will pretty much unload everything they have at even the site of a gun. Last one I can think of there was something like close to 300 rounds fired at a guy with a pellet gun.

They really need to put some major restrictions on LEO as well as make a degree mandatory to be one.

My first thought. The thugs usually don't leave a witness.

If no-knock raids become a common thing, then criminals will start busting down doors and yelling "police! police!!" to neutralize the victims - or at least to create enough hesitation.

Already happening

Same thing happened in Somerville, Texas back
in December 2013. Sheriff's deputy was killed
in the predawn no-knock raid. Grand jury refused
the indict the shooter.

Ya, this happened before. He should walk just the same.

His gunfire also struck the femur of Officer Odis Denton, 37, who underwent surgery and was later released from Scott & White Hospital.

Guy also shot two additional officers, who were unharmed due to the bullets striking protective gear.

Sounds like he is a fairly good shot and breaking into his house was a bad idea.

I loathe race baiters and hate making things about race, but I suspect they wouldnt be seeking the death penalty had the shooter been white.
Sort of.

They actually did seek the death penalty for the white guy in Somerville, which is two counties over from Killeen. However, the grand jury refused to indict. So to the extent you have a racial beef with anyone here, it's the grand juries and not the prosecutors. Prosecutors usually go apeshit whenever a cop gets shot no matter who the defendant is.

But McGee did have a felony quantity of drugs on him. (He didn't get off on those charges.) The idiocy of no-knock tactics aside, the warrant for the raid turned out to be factually accurate in that case. Not so here. The Guy case also features further absurdities like the cops all swearing in affidavits that, despite going through the trouble of getting a no-knock, they actually all decided to knock and announce when they arrived so how dare he shoot their upstanding comrade-in-arms. It's shady as all hell.

Now even though the counties are close by and probably demographically similar, obviously the two grand juries are composed of different people, so there's no way of knowing for sure. But speaking generally, I agree, and I don't think that's "race baiting." It's "acknowledging reality in rural Texas."

Wow 4 pages and no cops here defending this BS. Pleasantly surprised.

But then again they are also not here admonishing these cops actions, which does go along with the whole "look the other way" mentality...
