Jaywalking in against the law in most places, but rarely enforced...because to do so is almost in all cases way more trouble than simply saying, "Hey...wait for the crosswalk sign."
It's about scale of infraction versus scale of reaction. The guy may have, by the letter of the law, "stealing" soft drinks. But did that dollar amount warrant the reaction? I'd say most reasonable people who give the guy the benefit of the doubt that he really didn't know would say, no.

I get all that, but I highly doubt this is the first time someone got caught taking a free refill form there. Occasionally someone actually gets in trouble for breaking minor laws. If he doesn't like it, maybe he should make sure he's not the one in a million that actually gets prosecuted from now on.

I bet they had a problem with the construction workers in general strolling in and out all day refilling their drinks.

I have an even easier solution if that's the case (that people walk up and give themselves free refills)...have actual hospital workers fill drinks rather than making it accessible to everyone that can walk up and do it themselves. I've always kind of assumed that if a business is going to outsource the filling of my drink to me rather than having an employee do it, they are doing it as a cost cutting measure (why pay an employee if our customers will do it themselves?!?) then they must also assume I'm not expecting to have to walk over to the counter and ask them to charge me again for filling my own drink.
Honestly...I'm just arguing this point to have something to do. I really don;t care what they do with this clown, though I do think their reaction was wildly overboard.

Are there more cases of this? Doesn't seem likely they'd go through all that trouble to write one ticket.
