Because they probably have a low level person misreading the code and your tax filing. They sent me a snarky letter for a 2012 deduction and I sent them copies of the backup info and received a mea culpa letter from them roughly 90-days later. It would have been > $4600 in additional tax so yeah, I was happy.

Fight it if you know you are right and can make a strong case that your wife's situation qualifies for the credit.

I got a letter from the IRS a few years back saying that I reported wages incorrectly on my W2 (which was false). They said I owed more money. Really, they just fat-fingered a number when they were entering in my wages. I called to get it straightened out. I waited for 30 minutes, talked to a guy, and he was like "oh sorry. You're right. Fill this form out and should be fixed. We'll send you a letter saying you're cleared of any tax liability." Well, the guy ended up NOT fixing the error and instead caused ANOTHER error elsewhere, so that when the letter came in the mail it said we owed even MORE money. Call again, and suddenly they can't pull up any of tax information when on the previous call they had it all right in front of them. It was obnoxious. At the end of the day, I ended up just resending all the tax docs and I finally got a letter clearing me of any tax liability for that year. I know there are IRS places scattered around the US where you can talk to an actual person instead of fiddle farting around on the phone. May be worth your while.

For me, that whole process was a total clusterfrick. I wish you the best of luck in dealing it.

LOL you are giving them too much credit. This has all the markings (and timing) of the computer sending a letter. My guess is no human has looked at this at all.

With most people e-filing these days, there is nothing for the IRS people to type in. My guess is either the IRS didn't get the 1098-T or there is some other error on the system. The problem is, at the onset, the IRS assumes they are 100 percent correct.

Good luck to the OP. If you have the right documentation, it will eventually get fixed, but it might take a while and a whole lot of aggravation.

My dad is a CPA. I just handed it over to him today because he can call the preparer's phone line which has better reps. I just file my own taxes because he taught me how to do it and it's one less return he's got to deal with this time of year.

This is true... but that's like saying the Falcons were a better team than the Texans this past yeare. I call the PPS line at least three times a week, and at least half the time, I want to reach through the phone and strangle the rep on the other end of the call.

There is nothing quite like having a "special" number to call, having to wait 45 minutes for someone to actually get on the line, and then have that person have no idea what they are talking about. And... the best IRS reps are the ones that work with us. The ones the general public have to deal with... heaven help y'all.

Bump for update:

UPDATE: Sent them a response back in April with a copy of my 1098-T for 2012 as requested and a signed statement by both my wife and I certifying that this is correct.

They send me a response letter last week stating that they cannot give credit for paid education expense until a list of payments from your eligible education institution or signed statement from us verifying the amounts.

fricking thieves. I'm about to mail off an AUR audit very similar to yours. The IRS is challenging an IRA transfer...adding it to my income to make my wife ineligible for the Lifetime Learning Credit.

A list isn't even needed. Tuition alone (noted on the 1098t) is well above the threshold to get the lifetime learning credit.

I had this exact thing happen to a client. I made the client call the university and get a billing statement showing payments made to the university which were taken out of her paycheck(she worked at the school). Still haven't heard back from the IRS.
