These folks do not care to win people over... just have the government rule in their favor is all they need.

It's not a church.

Public venues can be privately owned. You can not tell a business what he can and can't do with his own business.

Sure, you can, with regard to some laws, including those that deal with discrimination (but not limited to them). You might disagree with it in this instance. But this is not an isolated case and has precedence in the state. In other states, too.

I don't know enough about this particular case to agree or disagree. And maybe the law, as written, isn't a good one.

If I owned an AC company and my tech refused to go into the home because there were people inside and out of the home worshiping with crazy snakes all over their bodies. I have a right to refuse service. Their religion pentecostal snake worship whatever does not trump anything no matter what state.

For a group that is claiming the operators of the business are violating their "rights", the messages sent to them just scream loudly as to the degree of inclusiveness they practice themselves in their own lives if public and privately. Their tolerance will drive people out of business for standing upon their religious grounds, so Iowas' law posted about is in violation by the state in the couples free exercise right in truth.

I'm sure in the future they will be considered public if they accept tax exempt status from the gov.

None of this is surprising.

The end game was always this.

Time for the legal battle to begin.

How have they been discriminated?

They are allowed to shop at, and purchase art at the gallery...just as the owners have said.

Interestingly, they wont rent their business to these people.

Unless their business is a a rental property, I fail to see how the gays are being discriminated against.

I'm sure, as a lawyer yourself, you could clear that up for me...

re: Business owners threatened, legal action; refusing facility for gay wedding

I found an article that semi decides this case but who is defining 'public venue.'

quote:

However, the Iowa Civil Rights Act, specifically Iowa Code section 216.7(1), states that it is "unfair or discriminatory" to deny services of public accommodations because of sexual orientation.

Since the U.S. Supreme Court decision on the so-called Defense of Marriage Act in June, and the Varnum v. Brien ruling over four years ago that paved the way for marriage equality in Iowa, we appreciate that this nation and the state of Iowa has experienced real change that may be challenging for some people. When the Jim Crow laws were overturned decades ago, the culture didn't change overnight even though the law did. Today, same-sex couples can legally marry in Iowa and have the same federal recognition as non-gay married spouses. So, while the law has changed we understand that the culture will take a little longer.

One Iowa respects and appreciates that Mr. and Mrs. Odgaard are Iowans with deeply held religious beliefs and convictions. At the same time, we need to separate our respect for the Odgaards' religious beliefs from the Iowa civil rights code.

While religious institutions are protected by religious freedoms, it's important to note that the Gortz Haus is a public venue. It cannot be confused with a religious institution.

The Odgaards provide a service to the public that must accommodate all Iowans, including the lesbian, gay, bisexual and transgender community.

Meh "states rights". If that's in Iowa's Code, that's the law. I don't see how you can complain about this law and support their neighboring state's right to ban gay marriage. States rights.

I'm sure their gallery doesnt discriminate on who they sell art to, or on who can browse the gallery. A full-on rental of their business may be a different animal.

Does anyone know if it would depend on how much of the business is contingent on rental?
