A good lawyer can make a world of difference. The good ones are expensive but most of the time (especially on first offenses) they can have the charges reduced and quite often can even get them dropped for a plethora of reasons ranging from the officer's improperly following procedure to casting doubt on the accuracy of the breathalyzer machine to proving that the person was improperly pulled over to begin with (although in OP's case running his truck into a ditch a few feet from the bar will probably throw that one out ).

Either way, I think just walking in and pleading guilty without having a lawyer is the worst choice possible. This could have an effect on his life for several years (and potentially longer if he drives for a living, is in the military, etc.) so it is worth spending the money necessary to protect himself. If he can't afford one, at least get a court-appointed one. It is better than nothing and you might luck out and actually get one that is half-decent.

Made the DWI mistake back in late 2005.

Court costs, fines and attorney costs came to a total of about $3.5k.

If you're in Louisiana, plead guilty under article 894 (i think that's it. keeps if off your record as long as you don't get another within 5 years).

Trying to fight it after blowing the # you blew would be stupid on your part.

Sorry. Meant to put that in there too. I wasn't twice the limit but damn close. I blew a .158. My lawyer was good but even he said the prosecutor likely wouldn't be willing to budge due to the high BAC and he was right.

Also, I forgot to include the $75/month for 2 years for probation fees.

So that brings my total out of pocket to $4300 give or take.

Yes I blew over twice the legal limit and had to get my truck towed out of a ditch. I'm 22 with no prior tickets on my record.

Not in 15th JDC. The Pre-Trial program is more strenuous than that. Community Service is double what a guilty plea would be with mandatory trash pickup. If he got breathalyzer removed by February, he'd be lucky.

It has. But I'm not current on it.

To those who know...is pre-trial even available when you blow .185 in EBR?

Also, pre-trial isn't statewide. It will depend on the parish.
