It's simple.

2A is the law.

GZ had a gun.

TM did not.

Ergo, TM was deprived of equal protection when GZ shot him unarmed

Let's examine the facts.

TM saw Z following him.

Instead of calling 911 and telling them that he is being followed by someone TM calls his girl friend and tells her that he is being followed by a dumb arse cracker.

Then instead of running away from Z as quickly as he could TM, not knowing that Z has a concealed gun, circles around and sucker punches Z in the nose, knocks him to the ground, jumps on him and begins pummeling him.

In fear of his life, Z is able to get his gun out and shoots TM in self defense.

Based on the facts, TM was not deprived of equal protection when GZ shot him unarmed.

double sovereigns (state and federal)

the feds and state can both try you for the same crime, under their respective set of laws. it almost fricked mike vick

that is BS and violates the consitituion. You are saying the federal government can after you are found not guilty on a crime by the state level try you again for the EXACT same crime and you could be found guilty.

So lets say one day I get accused of 2nd degree Murder I go to state court I'm acquitted of all charges, the federal government charges me again I go to court and I'm found guilty and have to spend the rest of my life in a federal prision.

How does that not violate double jeopardy?

so you can charge him for something else around the same act, but charging him of the same thing is legally impossible correct?

I can understand charging him of civil rights violation I just want to make sure I'm reading it correctly.

TIA

re: DOJ says Zimmerman cant have his gun back - FL law says it MUST be returned

quote:

As an example, a person who commits murder within the jurisdiction of a State is subject to that State's murder statute and the United States murder statute (18 U.S.C. § 1111). The Federal government will defer to the State to prosecute under their statute. Whatever the outcome of the trial, acquittal or conviction, the Department of Justice will presume that prosecution to vindicate any Federal interest and will not initiate prosecution under the United States Code.

However that presumption can be overcome. The policy stipulates five criteria that may overcome that presumption:
incompetence, corruption, intimidation, or undue influence
court or jury nullification in clear disregard of the evidence or the law
the unavailability of significant evidence, either because it was not timely discovered or known by the prosecution, or because it was kept from the trier of fact’s consideration because of an erroneous interpretation of the law
the failure in a prior state prosecution to prove an element of a state offense that is not an element of the contemplated federal offense
the exclusion of charges in a prior federal prosecution out of concern for fairness to other defendants, or for significant resource considerations that favored separate federal prosecutions

I guess this is the best thread to ask this question so here goes. Why do people like Sharpton and Jackson keep saying Trayvon broke no laws?Isn't attacking someone still against the law in this country?

There's been no finding that Trayvon attacked Zimmerman first, so technically they're right. Zimmerman's side of the story simply cast enough reasonable doubt on the state's theory (actually, I never heard the state advance a coherent theory) so as the jury felt they couldn't convict him, but the only person in the world who actually, definitely knows what happened that night is George Zimmerman.

Everything else is conjecture and speculation.

They are going to try and drag this bloody shirt to the 2014 elections which are starting to look like justifiable homicide at the polls for Dems unless they get the Obama coalition (young dumb stupid and minority) out in full force.

The trial evidence shows it's pretty safe to infer that TM attacked first.
