i dont know. i mean, all he did was write some lyrics over a tooled around with version of the Oldham cover. its a cover of a cover of a cover. he can claim it was a sample, but it was the whole damn melody. pretty tricky situation, could have gone either way imo.

The Verve had negotiated a license to use the oldham cover. The Stones won on the ground that the song used "too much". Complete BS. Absolutely indefensible. I mean, they were found to have infringed a copyright that they had a license to use. Nonsense.
