We already have sanctions (including ordering payment of some or all of the other party's attorney fees and costs) for filing frivolous claims and asserting frivolous defenses. Loser pays would discourage arguable but uncertain claims, which is of course exactly what the insurance companies want. Then, when only the most egregious cases ever get filed, they can spend all their time fighting those instead of settling them like they should.

Insurance companies make a TON from torts. They are without a doubt the #1 player.

I have a lot to learn on the subject, so i am asking this in all senserity.

But besides counter suing, what about the expenses for successfully defending non frivolous suits.
