Penn State is not being investigated for NCAA rules violations.

you are right, in the future that could happen, but NCAA rules were not violated. The NCAA is an athletic association, not Law Enforcement. It is not the role of groups like the NCAA to have rules pertaining to things outside of their scope.

The NCAA bylaws that put this situation within the scope of the NCAA have been posted plenty of times.

by the appropriate regional accrediting agency and duly elected to active membership under the provisions
of Constitution 3.2.3. (Revised: 1/15/11 effective 8/1/11)
3.2.1.2 Compliance With Association Rules. The institution shall administer its athletics programs in accordance
with the constitution, bylaws and other legislation of the Association.
3.2.1.3 Standards. The institution’s athletics programs shall reflect the establishment and maintenance of
high standards of personal honor, eligibility and fair play.
