What is Baylor's legal justification for a lawsuit

I understand why Baylor doesnt want the Big 12 to break up but dont understand what legal standing they have against A&M.

Why didnt they sue Colorado or Nebraska? Are they going to sue OU, OSU, Tech and TExas if they leave? How come Boise wasnt sued for leaving their conference. How come Va Tech wasnt sued. Is this a new tactic being employed?

Is Baylor saying that no teams can leave a conference anymore due to financial impact to other institutions?

They finally believe the hype. Big XII is exploding before their very eyes. But they should have said something when all this Longhorn network shite was getting stirred up. Now it's just crying over spilled milk.

As I understand it, they're not threatening to sue TAMU. Their only recourse against TAMU is contractual, i.e., the liquidated damages clause in the Big XII bylaws. Baylor is essentially threatening to sue the SEC for tortious interference.

after Colorado and Nebraska left the Big 12, the remaining teams made a "blood pact" to stay w/ the Big 12 for 10 years. however, A&M claims that the LHN substantially changed the deal nullifying the agreement. technically, A&M is still in the Big 12 until June 30, 2012, so there is plenty of time for other things to happen which would make Baylor's claim moot. i.e. OU to Pac 12.

You don't have to go any further than understand the mentality of the folks running Baylor. You know know who Ken Starr is who just happens to be the new President of Baylor after a lengthy battle between conservatives and moderates for the soul of Baylor University? Just read his bio and you will fully understand why Baylor is doing this. Gotta love how this group of Christians work!

In Texas, assuming Baylor sues the SEC for TI, it has to prove that the SEC willfully and intentionally interfered (if I recall correctly).....that seems an awfully high hurdle. Makes me think this is all posturing....or Baylor knows something we don't know.

baylor's got a contract claim against A&M, tortious interference against the SEC, and who knows? Maybe a fraud claim.

Baylor is not saying "we are going to sue". They are saying they don't want to surrender their right to sue. Why should they? If they are giving up something, they should get something. It's not in Baylor's interest to give up their rights in exchange for nothing. Would you?

In this situation, when is it not tortious interference. Are you telling me that Nebraska left the big 12 before having a spot secured with the big 10? Same thing with Colorado, Boise etc.

What school is going to leave a conference without having their plan in place. Therefore everyone has talked behind the scenes. How is the SEC any more liable than the Big 10 for Nebraska, or Pac 12 for Colorado
