Gay marriage lawsuit to be filed against the state of Alabama

It will be interesting to see how this plays out. One of Kennedy's reasonings for striking down DOMA was that DOMA was enacted out of animosity and hatred toward gays. I can almost guarantee that this will be one the arguments in a lawsuit against ALabama.

Of course the AG of Alabama and (I assume the governor) thinks the state's ban on gay marriage will stand up in court. But then George Wallace also thought the segregation laws would stand.

Alabama state representative Patricia Todd says she and her partner plan to legally challenge Alabama's constitutional ban on same sex marriage in light of the Supreme Court's decision to strike down the Defense of Marriage Act.

Todd (D-Birmingham) became the first openly gay public official in Alabama when she was elected in 2006 to represent the 54th District.

She says she has no confidence that the state legislature will legalize same sex marriage in Alabama.

"It's got to be in the courts. We are not known for legislative acts on civil rights until the federal courts mandate we do something, so this has got to be a court decision," she said.

Todd said Wednesday she has retained a lawyer and she and her partner are researching their options, which could include filing both federal and state lawsuits.

"Jennifer Clarke and I will be filing a challenge to Alabama's Constitutional Amendment banning same sex marriage following the Supreme Court decision," Todd said in an emailed statement.

She says attorney Joel Dillard will represent them in the lawsuit.

Todd is asking other same sex couples who were married in another state and live in Alabama to join their lawsuit so they can possibly turn it into a class action suit.

Don't really understand a leg conservatives have to stand on opposing this.

Forcing people to pay more taxes is against our ethos.

Being gay forced people to pay more. Reduce taxes, let them get married. It will have to go through the courts, but Alabama will have to accept gay marriage.

I say 2 years and one of the last states.

Since she has no faith in legislators to make law and feels the judicial should, maybe she should resign as a state legislator and run for a judge position.

This should be Alabama's response.

"Be it resolved that the State of Alabama shall not legally sanction nor label any personal relationship with the word 'marriage', and that we are committed to honoring and enforcing contractual arrangements between individuals regardless of race or gender, and regardless of what those individuals choose as their personal label for that arrangement."

As much as I support gay marriage being legal and I'm not afraid of it at all, I vehemently disagree with this. It has to be decided by the people/legislature. Judicial legislation/activism is never ever a good thing no matter the subject. It's basically forcing an ideal on people.

If gay marriage is fully legalized via the court system, it will set perception of gay marriage and public opinion of gays back for a while.

Louisiana's ban will soon be tested under the full faith and credit clause of the constitution. IMO
Kennedy wasn't ready to go nationwide with Perry which explains 3 of the 4 liberals' votes of no standing. They knew Kennedy's vote.

But what about folks married in other states and Louisiana's refusal to recognize them? I know of one couple who met in law school and have been together 25 years and were married in Connecticutt and will sue Louisiana on this issue.

So what you're saying is that they met in Louisiana and then went to Connecticut to get married there and then came back to Louisiana to sue? Is that what you're saying?

Why would they do that?

Why not move to the state they got married in?
