I'm assuming Administaff is a temp service not a payroll processing company like Paychex. Tell me again how Paychex is my employer just because they process my company's paychecks?
I won't. Because that's not what where talking about. I can think of a dozen contract staffing firms for drafters/designers in Houston that at former gigs we "employed" people out of for years. Not temp companies. Just companies that handle the paperwork side of things for a (VERY) nominal amount.

Sorry if I skipped over this, no Adminsitaff folks can be hire for one day, or years at a time.

The company we use issues all employee checks, W2's, handles all unemployment concerns, workers comp...my contract says the individuals are their employees...this is how they get reduced rates on workers comp, health insurance, etc...There may be 35 businesses under this umbrella, however, all the employees are treated as this company's employees....now, can the question be answered instead of some of you assuming you know more about this issue? I even talked to an owner of a temp/payroll company, and he believes this will destroy his business because the cost must be passed to his clients and their businesses cant support the increase.

This is completely different than a regular payroll setup. This is a Professional Employer Organization (PEO) which both Paychex and ADP (and others) offer where you are put into a large group. They become the employer of record for all unemployment, workers comp etc but you are still their employer. There are other rules that PEOs follow in order to allow handle services claims like you do but you are still ultimately responsible.

Holy shite you must be talking about a staffing service, yet you're saying payroll. I guess the fraudulent nature of your business has blurred the lines in your small mind.

Amazing.

Yes, you will pay around $1.30/hr or so more as a penalty because I can only assume you and your staffing agency will not offer decent insurance benefits.

Using a staffing service is fraudulent?

TA.....Administaff is now named Insperity....it was never a staffing/temp agency company hence the name change. Insperity is a PEO, which provides Human Resources and other services for small to mid-size companies.
