The constitution enumerates certain things the Federal Government can do. All other things are the province of the state governments. However, The Commerce Clause allows the Feds to take other powers that are necessary to regulate commerce. Well, the Federal Government has used the Commerce Clause to do all kinds of things. In fact, the Federal Government would probably be less than half its size if it wasn’t for that clause.
