All that said, it is never proper for a judge to have ex parte communications with a witness. It violates the 6th Amendment as well as Rule 2.9 of the ABA Model Rules for Professional Conduct. On its face, this judge should recuse himself. At minimum, the YSL matter is a mistrial....
