It literally says in the evidence rules in all 50 states and in the federal rules that an out of court statement used to impeach is not hearsay.

Will SFP or VOR address this particular aspect?

For anyone who hasn’t noticed the other thread yet, Cohen has been pressed and admitted stealing tens of thousands of dollars from the Trump Foundation.

Yeah, I think his credibility is officially impeached.

I assume that’s referring to an “admission against interest”. So yes that’s a thing.

I listen to everything, on all sides. I listened after specific events. This year that hast been limited to one episode after the Colorado/insurrection USSC ruling, and briefly scanning recent discussions (not total episodes) specifically for this issue (to experience the opposing echo chamber).

The last thing you'll ever catch me doing is limiting myself to any particular echo chamber.

I truly believe that we will see this drug out as far as possible and the judge will call a mistrial because of something the defense does.

This will allow all of the media to say he was not acquitted.

Merchan, just now, has decided that Trump's team can't use Brad Smith, an expert in campaign finance law, as a witness because it would "result in a battle of experts and confuse the jury."

Translation: We had no idea Cohen was going to be that much of a disaster and have to move the goalposts yet again.

ammunition for appeal.

I am convinced this was the goal all along - they probably knew they had no shot at a conviction (unless a windfall by the NY jury pool)

But the ace in the hole was a mistrial, that could not be addressed until after the election - giving the media the rest of the election cycle to gaslight the electorate.

same with appeals for a guilty verdict - which would would be icing on the cake for them.

only thing that will upset them is a 'not guilty' - but they are confident in their NY jury pool.

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Having the ability to subpoena witnesses is not the same thing as having an expert testify.

On re direct, the prosecution can only question topics that have already been introduced. They can't introduce new topics, right?
Asking because I don't know, I was never a fan of Perry Mason.

So the judge can decide the prosecutor's “experts” are ok, but not the defense’s experts?

Seems like it’d be both or neither allowed.
