Until I heard Robert Costello’s testimony, I would’ve said yes. I think Costello moves the case from a hung jury to an acquittal. He’s a very credible and compelling witness.

this - I think after his testimony, they could ask for a directed verdict of not guilty.
make the judge show his cards on this
does the jury get to hear the request for a directed verdict? or is that done with them out of the court?

save Costello for appeal just in case jury is "get Trump", which is possible.

Because he appeared before grand jury and has made public statements he wouldn't be ex parte.

Because he is connected to Guiliani you don't want to give a show trial more to show. Judge already allowed unrelated porn star testimony. If he's called as a defense witness judge will let prosecutors to go in all directions, related or not, on cross.

ETA: and you want Costello"s testimony "virgin" for Braggs suborning perjury case. Which the feds should pursue as part of election laws if Trump wins
