Andy McCarthy has been arguing that Trump's team should bring in Bob Costello because he's a sharp and seasoned defense attorney and would play well. And maybe try again to put up former FEC commissioner Bradley A Smith as well as an expert witness, even though the partisan hack judge didn't allow that to happen previously.


Eta: sorry I meant Bob Costello not Michael Cohen previously

Until I heard Robert Costello’s testimony, I would’ve said yes. I think Costello moves the case from a hung jury to an acquittal. He’s a very credible and compelling witness.

this - I think after his testimony, they could ask for a directed verdict of not guilty.
make the judge show his cards on this
does the jury get to hear the request for a directed verdict? or is that done with them out of the court?

My Father was a defendent in that EWE trial. The move to not present a defense, which almost killed my mother, as it was a RICO prosecution and we would have been left with basically the clothes on our backs, and my Father in prison for 250 years, was as much about it being a second trial with an 11-1 not guilty vote in the first, as it was about EWE being a bigger than life figure to the jury...
In hindsight, the move as brilliant. One, because it worked, and two because the jury was already exhausted of months of complicated business data that I don't think they fully understood.
I am not sure the Trump trial is similar enough in "scope" to do this.....building hospitals and nursing homes versus paying off gold digging porn stars to shut up.
Similar charismatic defendents, not similar crime content.

Not offering a defense means anything they could have argued on appeal not already raised goes away IIRC.

Yeah, after hearing Costello, they better put him on for dang sure, he has all the inside knowledge of how corrupt the prosecution was here, and all the excluded exculpatory evidence the Grand Jury never got to hear,

save Costello for appeal just in case jury is "get Trump", which is possible.

Because he appeared before grand jury and has made public statements he wouldn't be ex parte.

Because he is connected to Guiliani you don't want to give a show trial more to show. Judge already allowed unrelated porn star testimony. If he's called as a defense witness judge will let prosecutors to go in all directions, related or not, on cross.

ETA: and you want Costello"s testimony "virgin" for Braggs suborning perjury case. Which the feds should pursue as part of election laws if Trump wins

If they put up a defense (presuming a DV motion is denied after the state rests), it goes to the jury.

That said, I am sure this has been a hot discussion among his defense team.

If he doesn’t testify at trial, his evidence isn’t available for an appeal.

I know this is a spin off topic, but what would EWE think of Trump this time around and the long knives out to get Trump from all sides?

I know he was a diehard democrat but his wife was a Republican. Leading to one of his trademark sayings, I have finally found out what you can do with Republicans, sleep with them.

I think I’ve seen SFP say if the testimony isn’t presented at trial, it’s not admissible appeal.
