It’s contractual only because of the government making it so. Marriage existed long before the government issued a license for it.

For most people, marriage is first and foremost a religious ceremony, dedicating your lives to each other before God. It’s an oath between you, your spouse and God.

The government can marry two men. Two men married before God is blasphemy.
