Can you sue a public figure (let's say Jimmy Kimmel) if they edit a video to make it look like you're a whore and air it on their show?

I think that's the national media business model. Giving you an edit that may not tell the whole story.

Definitely; that would be a defamation claim, but you have to prove 1) that you've been defamed and 2) you have actual damages as a result.

The first step for production is licensing the video. Good luck complaining about creative editing.

Who is the YOU in this hypothetical? A public official or public figure will have to show Jimmy Kimmel aired it with actual malice.

I think the world does not believe Matt & Trey’s portrayal that you will identify as a woman and take over the female wrestling circuit (or was it powerlifting); so not sure what damages you sustained from that episodes

Pretty sure that entitles you to Sandmann money. Make sure you put a big number in your complaint because then they have to give it to you. Reach out to Rebel and SDVTiger on the Poli Board if you need more info.

Defamation covers false statements. I doubt it covers an edited video.

The literal first result on a google search of "does defamation cover an edited video"

quote:

In the case filed yesterday against Katie Couric, what essentially happened is this: Couric is the Executive Producer of a documentary on gun violence called Under the Gun. She invited members of the Virginia Citizens Defense League, a gun-rights organization, to be interviewed on camera. At one point in the film, she is shown asking the group this common question on the subject of background checks: “If there are no background checks for gun purchasers, how do you prevent felons or terrorists from purchasing a gun?” The various representatives of the VCDL sit in stunned silence and look away, as if they had never considered the question before. The camera then cuts away, leaving the viewer with the impression that none of the interviewees were able to come up with a single answer.

According to the allegations in VCDL’s complaint, this exchange never happened, at least not like this. In truth, they say, there was no awkward silence, and they responded to the question right away with a variety of answers. In fact, they allege, you can hear the unedited audio of the exchange here (and embedded below). The footage of the VCDL members twiddling their thumbs and looking silently around the room was taken at a different time, when Couric allegedly told them they needed to sit silently for ten seconds so that “recording equipment could be calibrated.”

quote:

Courts have recognized the many ways in which creative video editing can lead to defamation liability:

quote:

[T]elevision broadcasts add new and potentially significant variables to the defamation analysis. Courts must scrutinize the juxtaposition of the audio and video portions of a television program. In subtle ways, a television director can alter the tone of an otherwise innocuous broadcast. With the emerging popularity of self-styled “magazine” news programs, courts should be sensitive to the possibility that a transcript which appears relatively mild on its face may actually be, when the total mix of creative ingredients are considered, highly toxic. Indeed, a clever amalgamation of half-truths and opinion-like statements, adorned with orchestrated images and dramatic audio accompaniment, can be devastating when packaged in the powerful television medium.

So what happened is my sister was apparently on Jimmy Kimmel last night where they edited a clip of her from Family Feud making it look like she said she "sucks a lot of d----". Can we sue Jimmy for millions or what?

Is this the typical Kimmel Unnecessary Censorship bit?

If so, only the dimmest of wits would not recognize this as humor, even if they had never seen the years long gag.

And 3) You can't be a celebrity. Courts have made it near impossible for a celeb to sue for defamation. It can be done but the bar is much higher.

Yes.

ABC will offer a quick settlement of ~40K. If you decline and take it to court they will bury you. You will literally die before the case gets resolved in court.

You’re getting the “public figure” thing mixed up. It’s not that hard for you to win a slander lawsuit against a public figure like Jimmy Kimmel. It’s hard for a public figure like Kimmel to win a slander lawsuit against you. The viewpoint is that Kimmel chose to become a famous celebrity, and that one of the consequences he has to face for being a famous celebrity is that people will talk about him a lot, including saying false things about him. You on the other hand are just some normal person who has never sought out fame, so Jimmy Kimmel doesn’t have the right to say false things about you on his show.

Did you ask her if she signed a release for Family Feud? …what skillset did she present to the Family Feud producers that separated her from the rest? Did she tell them she "sucks a lot of d----“?
