Usually when people try to extort money for things that didn't happen people get out in front by contacting law enforcement and don't pay. This is all just another one of Trump's many lies that he could have squashed way back in 2015 or 2016 by simply saying "Yes, I had sex with both of them" and we wouldn't even be talking about it today. I will never understand why Trump digs in on such obvious lies it makes it so much more difficult than it should be.

The coverup is always worse than the crime (which is kind of interesting, because a direct payment and an NDA would not constitute a crime).
This is less about people living their lives in a way to avoid anyone trashing the legal system and more about moving in a way that doesn't expose you to potential criminal culpability.

IIRC, that's the hook to get around the SOL issue.
Even if the jury finds that this behavior violates the wacky business records law, they have to rely on a second statute with a longer SOL, which requires the campaign association.
The meat is the business records part.
