If the Supreme Court goes full retard today, Obama & Bush better get ready for murder charges.

There is almost no way they decide presidents don’t have full immunity.

Obama ordered the killing of Anwar al-Awalki, an American citizen in Yemen without any indictment or trial, alleging al-Awalki was an al-Qaeda leader. In fact, al-Awalki was merely a spokesperson. Two weeks later a drone strike ordered by Obama killed al-Awalki's sixteen year old son, also an American citizen. It does not appear the son had any involvement with al-Qaeda.

Pretty sure it was unofficially one of those positions before and they want to scrap the ambiguity because they figure he will win again.

If the USSC rules that there is no criminal liability for executive actions, Trump can still be prosecuted if it's ruled his actions weren't executive actions.

This is the real question. If the Supreme Court rules against Trump, it'll be on the basis that his actions were in the name of campaign re-election and not under the preview of the office of the President.

The executive duty to investigate this perceived/alleged fraud is to have the DOJ investigate. Trump/Barr doing this cannot be prosecuted under executive immunity, clearly.
Everything GWB and Obama did would fall under this umbrella.
The other stuff Trump did is nowhere near as clear as part of his official duties as the head of the Executive Branch. That's why his team is arguing he has closer to an absolute immunity.

It's amazing that there are still people who think the law and its consequences will be applied equally. That isn't how this works. They will hold Trump to the standard, not their own people. Here is what they will say:
"I have thoroughly reviewed the actions of President Obama along with other classified information and determined that there was no intent to deprive any innocent American citizen of his right to life. Further, his actions were arguably within the ambit of his authority under Article II of the United States Constitution and the AUMF Act to protect the nation during an ongoing military operation. Even if a prosecution were to improbably survive pretrial motions, securing a conviction by jury would be nearly impossible and a waste of taxpayer resources and the judicial economy."

i wish trumps lawyers would say that explicitly to remind them that ruling against trump means obama can be prosecuted for the hundreds of civilians he murdered with his endless drone attacks.

I will be curious to see what they say on this. It has been my understanding that Presidents dont have “full immunity” but are exempt from the court system. All charges leveled at the sitting POTUS have to go through Congress via the impeachment process and referred to the courts if needed after that. This is all about the balance of power built into the Constitution.
Constitutional scholars feel free to correct me if I am incorrect.
