Possible, if he was a real dumbass. A set up would almost certain mean cops are setting him up, so you'd have to be a real idiot to have a gun in hand.

If that is not the case, it is a scary though as to why he had a gun with him.

There was a case locally where a couple was arrested for child porn. They had no children, but their house had a fully set up nursery/kid's room. Thankfully, they never got to use it.
