You are so lost; Presidential immunity exists specifically so the opposition can’t “Trump up” charges for political reasons. Which is EXACTLY what the Biden DOJ is doing!

I want to vomit but I agree with your limited point there. Some of Trump’s legal arguments here are just laughably ridiculous—most notably “absolute” immunity and the impeachment/double jeopardy bullshite.

Both are just awful, and his team asserting them only undermines their more legitimate defenses.

No one disagrees.

The “meh” side of Trump’s case is that they are wanting to argue that anything at all he does as POTUS is immune from prosecution. That’s just….wrong.

POTUS. immunity only extends to official acts.

Remember how it took about 36-48 hours post J6 before every single Democrat and media person started simultaneously calling it an “insurrection”.

Then I have no issue with that argument, I was under the impression that they argued it applied to all actions while he was POTUS, regardless of whether it was an official act. Probably have shite mixed up.

That said, I’ll maintain my point as to the double jeopardy argument. It’s legitimately one of the dumbest legal arguments I have ever seen.

I disagree, this is just the first and most obvious question (can he even be charged?) that needs to be answered; they will know to what extent Presidential immunity is offered, from there they have a stronger defense position.
