Denied without prejudice. Which is isn’t a shock since the judge has consistently said this issue is something that should be argued over for jury instructions.
And note, this is not the motion for dismissal due to selective prosecution, which has a much greater likelihood of being granted.

Why doesn't the judge just say what everyone knows to be the case and dismiss all of this with prejudice? Everyone on the planet knows what's going on here.
The court's job is justice. It's one thing if Trump was the only person these circumstances applied to, but many others have done the same thing and Biden is far worse, yet a deliberate decision was made to not charge - except for Trump.
Everyone on Jack Smith's team needs to be fired and the judge needs to stop slow rolling this and just dismiss the case.
