Selective memory.
You forgot about the part where he was forced to follow through with the purchase after it was found out that Twitter had highly inflated it's value. The actual value of the company was significantly less than what he was forced to pay.

Musk has filed many lawsuits and, in fact, has one pending in TX against Media Matters and he's funding a suit against Disney. He filed a lawsuit against Twitter's lawyers in an attempt to claw back fees. The man is not afraid to file suit - he has the money to do it.
Further, Trump obtained a judgment against Stormy in Los Angeles. Los Angeles! Why? Because she lost her defamation case and got hit with an anti-slapp judgement. The law.
Now you can just sulk around acting like courts are just mean to idiots or live in the real world where you can bring a business lawsuit or really any legitimate lawsuit and obtain a judgment in your favor.
Musk isn't filing suit because he can't. He won't be able to prove it and who is there to really sue? The money is gone out to investors without any retention. That's the reality.
But made up shite sounds better I guess.
