Trump's continuing to make public defenses (not what any defense lawyer would advise, btw), and changing his story on this. He started off saying that he was talking about articles (which is bizarre because he's talking about how they're confidential) and now that he was making bragging claims about his golf courses. I guess he's trying to influence the jury pool. Any other idea on this weird strategy?

There are hundreds of documents. They charged 31 of them. Many of them are too secret to even be publicly disclosed.

I guess the feds don't need to find it then. That leaves them with a recording of Trump saying he still possesses classified documents and knows they don't become declassified simply by being in his possession.

Which is meaningless. He's already asserted his rights. It doesn't matter what he said on some recording. He can't make the law appear or disappear.

If Trump's lawyers are competent, he'll make the defense that this document being in evidence and/or this conversation occurring in NJ makes it immaterial to his case, but the prosecution will argue that this recording and the testimony of up to 6 witnesses to the Grand Jury relevant to his state of mind about the nature of the documents he'd retained, whether they're his or their classified and who should see them is relevant.

It will be adjudicated, baw.

Once again, they do not need to have it. You saying they do is patently false. There would be other ways to corroborate Trump's confession.

2nd, there are what? 36? Other charges in the indictment about a variety of other documents? So the discussion on that is rather moot.


They are using the audio as a framing device at worst. Trump: admitting to having documents he should not, saying he KNEW he should not have them, and pretending to show them to an audience.

And then showing that he had a variety of other documents he refused to return, that he should not have, and was improperly storing said documents.

This is not hard.

(and AGAIN: I think the DOJ are scum and shouldn't be doing this)

If the tape is to be believed as true and not just puffery, then nobody else saw the documents. So how would they corroborate? This is evidence 101.

This seems to be more likely to me. When you read the next paragraph in the indictment Trump allegedly shows a PAC representative a classified map of a country and says that “he should not be showing the map to the PAC Representative and not to get to close.” Much more likely that this stuff will be offered to prove a general state of mind that he knows classified materials are something that the government protects. Read it in conjunction with other quotes from Trump in the indictment about the importance of protecting government secrets.

This is a lack of self awareness friend.

I am telling you, as a lawyer, you are mostly not correct in your assertion.

IF they do not have the document, and IF they have no other way to corroborate Trump's confession, it would be an issue for this one singular instance.

But again, I don't think they are using the tape like you think they are.
